Terms and Conditions

The rules of the job, written so you can actually read them. Nothing in here takes away a right you have under Australian Consumer Law.

The agreement

These terms apply when you book pest control work with Pest Hunter. Booking a job, in writing or over the phone, means you accept them.

Quotes and pricing

Quotes are given on the basis of what you describe to us and, where we have attended, what we were able to see. A quote is valid for 30 days.

The price we give you does not change on the day unless the scope changes, for example where you add another pest or another area, or where the property turns out to be materially different from what was described. If that happens we will tell you the revised price before we do the extra work, not afterwards.

We do not publish fixed prices for this work, because the correct price genuinely depends on the pest, the property and how far the problem has gone. We quote every job individually.

Access and preparation

You are responsible for providing safe access to the areas that need to be treated, including the roof manhole and the subfloor hatch where those form part of the job.

Where preparation is required, for example clearing a pantry, washing bedding at temperature for a flea or bed bug job, or moving items away from skirting boards, we will tell you in advance. A treatment carried out where the preparation was not done may not work, and the warranty may not apply.

You must tell us before we start if there is anyone at the property with an allergy, asthma or a chemical sensitivity, if there are pets, chickens, fish or beehives on site, or if any part of the property is unsafe to enter.

How we carry out the work

All treatments use products registered with the Australian Pesticides and Veterinary Medicines Authority for the pest and the situation, applied in accordance with the label. Our technicians hold the licences required to apply them.

You will receive a record of the treatment showing the areas treated and the products used. Follow the re entry time and any other instructions we give you on the day.

What a treatment can and cannot do

We want this in writing because it is where most disputes in this industry come from.

  • Pest control reduces and controls a population and closes the way back in. It does not make a property permanently immune to pests. Anything living can arrive from a neighbouring property, a delivery box or a new gap that opens up.
  • Some pests, including German cockroaches and bed bugs, require a program of more than one visit because no product available affects the egg stage. Where that applies we tell you before you book, and the warranty relates to the completed program rather than the first visit.
  • Where the source of the problem is on a neighbouring property or in shared building space, we can treat and proof your property but we cannot control the source. We will tell you plainly when we believe that is the situation.
  • We do not carry out termite work of any kind, including inspections. If you suspect termites, engage a specialist termite inspector.

Wildlife and the law

Possums are protected wildlife under the Victorian Wildlife Act 1975. Where a brushtail possum is inside a building it may be trapped only in accordance with the Act, and the animal must then be released on the same property, within 50 metres of the point of capture, on the same night, or taken to a veterinary practitioner if it is sick or injured.

We cannot take a possum away and release it elsewhere, and neither can anybody else operating lawfully. Our possum service is exclusion and proofing: a one way door and the sealing of entry points. Nothing in these terms should be read as an offer to relocate protected wildlife.

We will not seal a roof where there is reason to believe dependent young are inside, and we will not act where doing so would breach the Act.

Our warranty

Where a warranty period applies to your job we will tell you what it is, in writing, before we start. It varies by pest, because the biology varies.

If activity returns within the warranty period, and within the scope of the work booked, contact us and we will return and re treat at no charge.

  • The warranty covers the pest and the areas that were treated, not a new and different pest.
  • It assumes the preparation and aftercare instructions were followed.
  • It does not cover a fresh introduction from outside, for example fleas carried in by an untreated animal, or a new colony arriving from a neighbouring property.
  • It does not apply where another party has treated the property after us in a way that interferes with our work.

Payment and cancellation

Payment is due on completion unless we have agreed other terms in writing with you, which is common for commercial and strata accounts.

If you need to cancel or reschedule, please give us as much notice as you can. Where our technician attends at the agreed time and cannot get access, a callout fee may apply, and we will have told you that at the time of booking.

Liability and your consumer rights

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, Schedule 2 of the Competition and Consumer Act 2010. Those guarantees cannot be contracted out of, and we are not trying to.

Our services come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement service or a refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage.

Beyond those guarantees, and to the extent the law allows, our liability is limited to resupplying the service or paying the cost of having it resupplied. We are not liable for loss arising from pre existing structural damage, pre existing infestation not disclosed to us, or a failure to follow preparation or aftercare instructions.

We carry public liability insurance covering our residential and commercial work. Commercial clients can request a certificate of currency.

Governing law

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction. If any part of these terms is found to be unenforceable, the rest continues to apply.
